One Vehicle Accident Causes Injuries In Scott County, MS

A one vehicle accident caused injuries to Carolyn McMillan, Christina Latendress and her three year old son when the driver, Carolyn McMillan, who was driving a white four-door Plymouth west on Ludlow Road lost control, overturned, skidded through a ditch, hit a stump and then caught on fire. The occupants were trapped inside of the vehicle. A first responder arrived and knocked a window out and cut the baby's seat belt off of the car seat and got the baby to safety, but could not get the driver out. The fire was getting bigger and two other passersby got the driver out. Two victims were transported by air to the University Medical Center in Jackson, MS.

Christina Latendress and her son can make a claim against the driver's insurance company for loosing control of her vehicle;they also can make a claim under the medical pay provisions of the same policy. Also, they can make a claim against their own insurance company for underinsured motorist benefits and medical pay benefits. Certain restrictions apply so you may want to consult with a Mississippi Accident Lawyer to discuss your legal rights.

18 Wheeler Causes Accident In Madison, MS

An 18 wheeler traveling north on I-55 crossed the median and struck a car traveling south on I-55 sending the driver, Crystal Emery to the hospital. Ms. Emery had to be extricated from her vehicle and transported to University Medical Center where she remained in critical condition.18 wheeler.jpg

Ms. Emery can make a claim against the 18 wheeler company for causing this accident. A lot of times these truck drivers work too many hours on the road and fall asleep or drive fatigued which contributes to accidents. If you compare the truck drivers log book to the number of hours that he/she is supposed to work and/or rest, then you can usually determine if they falsified they log books.

We have handled numerous cases where the truck driver falsified his log book in order to make more money by traveling more miles on the highway. This is a known, but tolerated practice by the companies who employ the truck drivers. If the attorney can get proof on the company that they had a practice of letting their truck drivers drive over the limit, then a claim could be made out for punitive damages against the trucking company. Here is a good example of what I am talking about. This 18 wheeler driver lost control of his tractor-trailer rig carrying a load of bananas.bananas.jpg

If you know of someone who was injured or killed in an 18 wheeler accident and have some questions about the case, call Paul Snow to discuss your legal rights FREE. To find out if you have a case, call 601-969-1977 or contact us online. We represent clients all over MS including Madison, Ridgeland, Jackson, Gulfport, Biloxi, Hattiesburg, Greenville, Meridian, and Natchez.

Jackson, MS Mechanic Killed In Accident At Work

Hyreese Loftin was killed in an accident on the job at a local truck stop. Mr. Loftin was working on an 18 wheeler when some compression equipment exploded and hit him in the head. Mr. Loftin died of head injuries within an hour at University Medical Center.

Since Mr. Loftin was on the job when the accident happened, then the family can make a claim for worker's compensation benefits against his employer's insurance company;but, those benefits are severely limited. A claim can also be made against the manufacturer of the equipment that caused the accident. IF a recovery is made against the equipment maker, then the worker's compensation insurance company will get their money back that was paid out to the family.

In my practice I have seen a number of accidents with these big tire machines that blow up and cause head injuries and death to the worker. If you know of a worker who has been injured or killed working on 18 wheelers, call Mississippi Accident Lawyer Paul Snow to discuss your legal rights FREE of charge. Call 601-969-1977 to find out if you have a case or contact us online. We represent clients all over MS including Jackson, Tupelo, Southaven, Vicksburg, and Pascagoula.

Two Tougaloo Students Killed In Head-On Accident In Jackson, MS

Kiara Taylor and Shanna Whitt, of Greenville, MS were both killed in an accident at North State Street near College Drive in Jackson, MS. They were cheerleaders at the Tougaloo college. Another cheerleader in the car was taken to a local hospital along with the driver of the SUV that was hit head-on. Supposedly, a black SUV contributed to the accident and caused the car to travel into the wrong lane and hit the red SUV.tug.jpg

WHO CAN MAKE A CLAIM AGAINST WHOM AND WHY?
Anyone hurt or killed in the accident may be able to make a claim against the driver of the red car for failure to keep proper control of the vehicle. It appears that a black SUV may be involved, but if this person is not ever found and their vehicles never made contact with the red car, then no claim can be made against this driver. On the other hand, if the black SUV and the red car had actual physical contact, then claims can be made under the uninsured motorist provisions of the red car's policy and any policy owned by the victim's families.

School Crossing Guard Hit While Directing Traffic In Biloxi, MS

Donald Williams, a school crossing guard, was directing traffic at Popp's Ferry Elementary school when he was hit on the right side by a truck. Mr. Williams was directing a bus to enter Pass Road from Agincourt Avenue. Mr. Williams was seriously injured with a broken pelvis, punctured lung and three broken ribs. He was taken to Biloxi Regional Medical Center and later transferred to a hospital in Mobile, AL.2030_02_1---Yellow-School-Bus_web.jpg

What was the driver of the truck thinking? When you go through a school zone, you are supposed to slow down to almost nothing. Not only did the driver not slow down, but then he failed to see Mr. Williams directing traffic. Mr. Williams can make a claim against the truck driver's insurance company in addition to making a claim for worker's compensation benefits since he was on the job at the time of the accident. If the driver did not have enough insurance coverage to cover all of the damages, then Mr. Williams can make a claim against his own insurance company for underinsured motorist benefits.

Waveland Police Officer Kills Bicyclist In Hancock County, MS

A Waveland Police Officer caused a wreck when he swerved his patrol car out of a turn lane and into oncoming traffic. His car collided with a Cadillac Escalade which caused the Escalade to go out of control which struck the bicyclist, Francisco Jesus Mendoza Suarez. The accident happened on U.S. 90 at about 10 p.m. Both vehicles were totaled out. Mr. Suarez was pronounced dead at Hancock Medical Center. John Baudoin, the driver of the Escalade, was taken to Gulfport Memorial with serious injuries.

WHOM CAN SUE WHOM AND WHY? This is another example of a cop supposedly turning on his blue lights and then totaling ignoring anyone else on the highway. Why was it so important to pull out in front of oncoming traffic to try to catch someone on a bicycle? Why didn't the cop wait a second until traffic was clear before crossing over the highway? There was no emergency, nor crime in progress. So, the family of Mr. Suarez can make a claim against the Waveland Police Department for killing their loved one. Also, Mr. Baudoin, can make a claim for his injuries. There is just no excuse for this senseless accident. This accident is covered under the Mississippi Tort Claims Act which covers all accidents involving government agencies.

If you know of someone who has been killed or injured by a Police vehicle or any other government vehicle and have some questions about the accident, call a Mississippi Accident Lawyer now. One Dead And Three Injured In Car Crash Near Meridian, MS

A freshman at East Mississippi Community College, Davishe Walker, was killed when the vehicle she was riding in turned in front of a Ford pickup truck on Hwy. 45 near Scooba, MS. The driver of the car failed to yield the right of way to the oncoming truck. Ms. Walker was an honors student and a member of the choir and band. She was pronounced dead on the scene. Three other EMCC students were injured and taken to the local hospital in Meridian, MS.

WHOM CAN MAKE A CLAIM AGAINST WHOM AND WHY? Anyone who was injured can make a claim against the driver of the car for failing to yield the right of way to the truck; this includes the family of Ms. Walker. IF there is not enough insurance to cover all of the damages, then claims could be made against the injured parties own insurance for underinsured motorist coverage. For example, if the driver of the car only had $25,000 of insurance, and the family of Ms. Walker had $100,000 of underinsured motorist coverage, then the family can claim $25,000 from the driver's insurance company and $75,000 from their own insurance company.

Also, claims can be made under the medical pay benefits of the policy for medical and/or funeral bills.

If you know of someone who was killed or hurt in an accident, and you have some questions, call Mississippi Accident Lawyer Paul Snow for a FREE consultation at 601-969-1977 or contact him online. SUV Hits Bicyclist In Bay St. Louis, MS

A bicyclist was hit by an SUV while being stopped for questioning near Hwy. 90 and Bouslog Street. A Waveland Police officer stopped the man for questioning when the accident happened. He was taken to a local hospital with life-threatening injuries. The Mississippi Highway Patrol is investigating the accident.

WHO CAN SUE WHOM AND WHY?
Of course, the injured party can make a claim against the driver of the SUV and his/her insurance company for running into the cyclist;but, a claim may also be made against the Waveland Police Department if the officer did not follow proper procedures when he pulled the bicyclist over to talk with him. In other words, if the officer told the man to stand near the highway and then the accident happened, then the City of Waveland may be liable for contributing to the accident. The officer should have told the man to stand away from the highway so that he could not get hit by any passing motorist.

If you know of someone who has a claim against a police officer or any other government agency and would like to see if you have a case, call Paul Snow at 601-969-1977 or contact us online. Fiery Head-On Crash Causes Three Wrongful Deaths Near Laurel, MS

Jamie Russell of Columbia was driving a 2002 Ford F-150 truck westbound with passengers Adrianna Batimon of Carson, and Taylor Newsome of Prentiss when a collision occurred with a 2007 Ford F-150 truck driven eastbound by Dustin White of Sumrall. The accident happened at the intersection of Miss. 588 and Sandhill Church Road about four miles outside of Ellisville. After the accident, the vehicles exploded and caught on fire.jc pic.jpg Three people were killed in the accident: Jasmine Russell, Adrianna Batimon and Dustin White. Taylor Newsome was in critical condition at the local hospital. Rescuers tried unsuccessfully to pull Mr. White from his vehicle and went to the other vehicle to help get Newsome out who was screaming for help. Those guys deserve a medal for saving Newsome's life because Newsome was rescued just before the vehicle exploded. Three of those involved attended Jones County Junior College.

WHO CAN SUE WHOM AND WHY? Any one who was hurt or killed by the at-fault driver can make a claim against the at-fault's driver's estate and/or his insurance company for causing the wreck. Since this accident involved a head-on collision, one of the driver's must have crossed over the center line or one of the driver's failed to yield the right of way to the other driver;but, one of the drivers was at fault. So, assuming that Mr. White was at fault, then the families of Jasmine Russell, Adrianna Batimon and Taylor Newsome can make a claim against Mr. White's insurance company. On the other hand, if Ms. Jasmine Russell was at fault, then the family of Mr. White, Adrianna Batimon and Taylor Newsome can make a claim agasint Ms. Russell's insurance company.

Also, if the at fault driver did not have enough insurance coverage to cover all of the damages, then claims could be made against their own insurance company for uninsured/underinsured motorists benefits in addition to medical pay benefits(which does include funeral benefits). Damages for wrongful death include loss of income, loss of love, society and affection of the family, pain and suffering, mental anguish, medical and funeral expenses, and all other damages allowed by law for the wrongful death. Personal injury damages include pain and suffering, mental anguish, lost income, medical bills past and future, reduced earning capacity, scarring and any other damages by law for receiving permanent injuries.jc pic1.jpg
