Charmaine Maxey, who was pregnant at the time, was shot in the stomach by Clifford Noel while they were parked inside a car in front of Noel's house. Ms. Maxey was in the passenger seat and Noel was in the driver's seat. Apparently, Noel and another man were playing around and the gun went off. The fetus died and the mother is in serious condition at University Medical Center in Jackson, MS.
WHO CAN MAKE A CLAIM AGAINST WHOM AND WHY? The family members of the deceased infant and the mother can make a claim against the shooter of the gun and the other man who was involved in the horseplay which resulted in the gun being discharged. This incident will probably be covered by each man's homeowner's insurance policy since the shooting was an accident. Also, the medical pay parts of the car policy may help cover the funeral bill for the infant and the medical bills of the mother. Separate limits should apply to each one. A close reading of the car policy may provide liability coverage for the shooter's actions.
