A longtime newspaper carrier, Winston "Ringo" Minor, was hit by an 18 wheeler when Mr. Minor attempted to cross Hwy. 182 near Starkville, MS. Mr. Minor was driving a 2003 Ford Explorer with his dog, Abigail, a German Shepard who always rode with him. The 18 wheeler was a 2007 Freightliner who was going west on Hwy. 182. The front of the tractor-trailer truck hit the driver's side of Mr. Minor's SUV. The dog was not hurt, but Mr. Minor, in critical condition, was taken to Oktibbeha County Hospital and then transferred to University Medical Center in Jackson, MS by helicopter. He sustained serious wounds to his head and face. He is presently in the Intensive Care Unit. 
Mr. Minor may have a claim against the insurance company for the 18 wheeler because a vehicle who enters the intersection first has the right of way even though that vehicle may be crossing from a side street. See Mississippi Code 63-3-801(1). Also, when two vehicles enter an intersection at the same time, the vehicle on the left shall yield the right of way to the vehicle on the right. See 63-3-801(2). It appears that Mr. Minor either entered the intersection first or was there at the same time, therefore, the 18 wheeler should have yielded the right of way to Mr. Minor's vehicle.
