A bicyclist was hit by an SUV while being stopped for questioning near Hwy. 90 and Bouslog Street. A Waveland Police officer stopped the man for questioning when the accident happened. He was taken to a local hospital with life-threatening injuries. The Mississippi Highway Patrol is investigating the accident.
WHO CAN SUE WHOM AND WHY? Of course, the injured party can make a claim against the driver of the SUV and his/her insurance company for running into the cyclist;but, a claim may also be made against the Waveland Police Department if the officer did not follow proper procedures when he pulled the bicyclist over to talk with him. In other words, if the officer told the man to stand near the highway and then the accident happened, then the City of Waveland may be liable for contributing to the accident. The officer should have told the man to stand away from the highway so that he could not get hit by any passing motorist.
