Waveland Police Officer Kills Bicyclist In Hancock County, MS

A Waveland Police Officer caused a wreck when he swerved his patrol car out of a turn lane and into oncoming traffic. His car collided with a Cadillac Escalade which caused the Escalade to go out of control which struck the bicyclist, Francisco Jesus Mendoza Suarez. The accident happened on U.S. 90 at about 10 p.m. Both vehicles were totaled out. Mr. Suarez was pronounced dead at Hancock Medical Center. John Baudoin, the driver of the Escalade, was taken to Gulfport Memorial with serious injuries.

WHOM CAN SUE WHOM AND WHY? This is another example of a cop supposedly turning on his blue lights and then totaling ignoring anyone else on the highway. Why was it so important to pull out in front of oncoming traffic to try to catch someone on a bicycle? Why didn't the cop wait a second until traffic was clear before crossing over the highway? There was no emergency, nor crime in progress. So, the family of Mr. Suarez can make a claim against the Waveland Police Department for killing their loved one. Also, Mr. Baudoin, can make a claim for his injuries. There is just no excuse for this senseless accident. This accident is covered under the Mississippi Tort Claims Act which covers all accidents involving government agencies.

One Dead And Three Injured In Car Crash Near Meridian, MS

A freshman at East Mississippi Community College, Davishe Walker, was killed when the vehicle she was riding in turned in front of a Ford pickup truck on Hwy. 45 near Scooba, MS. The driver of the car failed to yield the right of way to the oncoming truck. Ms. Walker was an honors student and a member of the choir and band. She was pronounced dead on the scene. Three other EMCC students were injured and taken to the local hospital in Meridian, MS.

WHOM CAN MAKE A CLAIM AGAINST WHOM AND WHY? Anyone who was injured can make a claim against the driver of the car for failing to yield the right of way to the truck; this includes the family of Ms. Walker. IF there is not enough insurance to cover all of the damages, then claims could be made against the injured parties own insurance for underinsured motorist coverage. For example, if the driver of the car only had $25,000 of insurance, and the family of Ms. Walker had $100,000 of underinsured motorist coverage, then the family can claim $25,000 from the driver's insurance company and $75,000 from their own insurance company.

Also, claims can be made under the medical pay benefits of the policy for medical and/or funeral bills.

SUV Hits Bicyclist In Bay St. Louis, MS

A bicyclist was hit by an SUV while being stopped for questioning near Hwy. 90 and Bouslog Street. A Waveland Police officer stopped the man for questioning when the accident happened. He was taken to a local hospital with life-threatening injuries. The Mississippi Highway Patrol is investigating the accident.

WHO CAN SUE WHOM AND WHY?
Of course, the injured party can make a claim against the driver of the SUV and his/her insurance company for running into the cyclist;but, a claim may also be made against the Waveland Police Department if the officer did not follow proper procedures when he pulled the bicyclist over to talk with him. In other words, if the officer told the man to stand near the highway and then the accident happened, then the City of Waveland may be liable for contributing to the accident. The officer should have told the man to stand away from the highway so that he could not get hit by any passing motorist.

If you know of someone who has a claim against a police officer or any other government agency and would like to see if you have a case, call Paul Snow at 601-969-1977 or contact us online. Fiery Head-On Crash Causes Three Wrongful Deaths Near Laurel, MS

Jamie Russell of Columbia was driving a 2002 Ford F-150 truck westbound with passengers Adrianna Batimon of Carson, and Taylor Newsome of Prentiss when a collision occurred with a 2007 Ford F-150 truck driven eastbound by Dustin White of Sumrall. The accident happened at the intersection of Miss. 588 and Sandhill Church Road about four miles outside of Ellisville. After the accident, the vehicles exploded and caught on fire.jc pic.jpg Three people were killed in the accident: Jasmine Russell, Adrianna Batimon and Dustin White. Taylor Newsome was in critical condition at the local hospital. Rescuers tried unsuccessfully to pull Mr. White from his vehicle and went to the other vehicle to help get Newsome out who was screaming for help. Those guys deserve a medal for saving Newsome's life because Newsome was rescued just before the vehicle exploded. Three of those involved attended Jones County Junior College.

WHO CAN SUE WHOM AND WHY? Any one who was hurt or killed by the at-fault driver can make a claim against the at-fault's driver's estate and/or his insurance company for causing the wreck. Since this accident involved a head-on collision, one of the driver's must have crossed over the center line or one of the driver's failed to yield the right of way to the other driver;but, one of the drivers was at fault. So, assuming that Mr. White was at fault, then the families of Jasmine Russell, Adrianna Batimon and Taylor Newsome can make a claim against Mr. White's insurance company. On the other hand, if Ms. Jasmine Russell was at fault, then the family of Mr. White, Adrianna Batimon and Taylor Newsome can make a claim agasint Ms. Russell's insurance company.

Also, if the at fault driver did not have enough insurance coverage to cover all of the damages, then claims could be made against their own insurance company for uninsured/underinsured motorists benefits in addition to medical pay benefits(which does include funeral benefits). Damages for wrongful death include loss of income, loss of love, society and affection of the family, pain and suffering, mental anguish, medical and funeral expenses, and all other damages allowed by law for the wrongful death. Personal injury damages include pain and suffering, mental anguish, lost income, medical bills past and future, reduced earning capacity, scarring and any other damages by law for receiving permanent injuries.jc pic1.jpg

Charles Farmer, an FAA inspector from Alabama was killed and Larry Wells of Crystal Springs is in critical condition at the University Medical Center after their Robinson R-44 helicopter went down and crashed into a vacant house. They were practicing aerial maneuvers. It is possible that the rotor broke in the air causing the crash. Both men were experienced pilots and one was giving the other a proficiency check.helicopter.jpg

Also, the owner of the helicopter may be sued if the helicopter was not properly maintained. There may be other causes of action for this accident, but an investigation needs to be completed first.

Would A Lawsuit Get Someone's Attention In Lincoln County, MS ?

How many accidents have to happen until something is done to correct the problem? Apparently 36 accidents at the intersection of Hwy. 84 with Jackson-Liberty Drive since 2006 is not enough to get the job done. IF THAT DOESN'T DO IT, THEN WHAT DOES? How many people have to be killed and/or injured for life before the problem is corrected? The intersection know as Laird's Crossing is causing a controversy in the county. The sheriff has written a letter to MDOT; the board of supervisors is about to write a letter to MDOT; the local fire dept. has obtained about 5,500 signatures on a petition calling for major change at the deadly intersection;the daily newspaper published an article about the intersection accidents; and MDOT is PLANNING a sizeable project. turned over suv.jpg

Well, how many more people have to die while some committee has a bunch of meetings PLANNING the project? The president of the board said: "y'all don't see it, but we do - we're the ones who have to drag the dead bodies out of the cars."

A dip in the road hides cars on the highway which blocks the view of that vehicle when someone attempts to cross the highway. Local authorities want a four way stop sign put up NOW, but MDOT wants to study the matter. Go figure. I wonder how long MDOT would study the matter if the families of the people who were killed or severely injured in accidents at this intersection filed a lawsuit against MDOT for failure to correct a known dangerous condition for a long time? I bet that a four way stop sign would be constructed overnight the day after a lawsuit was filed.

IF you know of someone who has been injured or killed by the negligence of MDOT or any other Governmental agency, and would like to discuss your legal rights, call Paul Snow now at 601-969-1977 or contact us online. We do not charge any attorney fees unless we recover for you. Don't wait until it is too late to talk with an attorney who specializes in accident cases. We represent clients all over MS including Lincoln county, Hinds county, Madison county, Rankin county and Warren county.american flag.jpg

If you know of someone who was involved in a hit-and-run accident, call Paul Snow now to discuss your legal rights. We offer a FREE consultation to see whether or not you have a case. Call 601-969-1977 or contact us online. We represent clients all over MS and LA in all kinds of accident cases including Natchez, Clarksdale, Ridgeland, Greenwood and Laurel.
