ATV DUI Puts Four In Jackson, Mississippi Hospital

Jerry Thornton of Florence, MS was arrested for DUI as a result of an accident that happened on Hwy. 49 just south of Florence. Thornton was driving the ATV four wheeler with three children on board; he drove across the highway and made it to the median, but an SUV, driven by Thomas Arrington, swerved into the median and hit the ATV. All of the victims suffered serious injuries and were taken to University Medical Center in Jackson, MS.

WHO CAN SUE WHOM AND WHY? The driver of the ATV can be sued for driving while under the influence of alcohol and careless driving. But, that is not all. The driver of the SUV who actually hit the four wheeler may also be partly at fault for following the vehicle in front of him to closely. The car in front of the SUV slammed on brakes to miss the four wheeler. If the SUV driver were not speeding nor following to close, then he could have avoided the accident, so he has some liability for contributing to this accident.
