Southaven, Mississippi Crash Kills Six Year Old Girl

A wreck involving four cars and an 18 wheeler took the life of a 6 year old girl who was ejected from the car. The accident started when John Henry Brown attempted to pass an 18 wheeler on the right shoulder of the road in the southbound lanes of I-55 at the Horn Lake Creek bridge. Brown pulled in front of the truck and then the driver of the tractor-trailer rig swerved to miss Brown and collided with another car knocking it into the guard rail.

Four vehicles were involved and the tractor-trailer. Five people were injured and taken to the local hospital.

Who can sue whom and why? Anyone hurt or killed in the accident can sue the driver of the car who tried to pass the 18 wheeler on the right shoulder of the road; this includes the driver of the 18 wheeler and any drivers or passengers of the other vehicles involved in the accident.  If the driver of the 18 wheeler could have driven straight forward without swerving and knocking the second car into the guard rail, then the 18 wheeler company can be sued for contributing to the accident and resulting injuries and death of the 6 yr. old. The driver of a big rig should not just blindly pull over into someone else's lane of travel without first making sure that it could be done safely.
